Amendment to the Mining Act 1978 came into effect on 8 February 2017

The Licensing Provisions Amendment Act 2016 came into effect on 8 February 2017.

 

The Licensing Provisions Amendment Act 2016 came into effect on 8 February 2017. This Act amended the Mining Act 1978 in three respects:

1.     Section 17 was added to the Mining Act 1978 to permit certain notices by the Minister, a warden or an official of the Department of Mines and Petroleum to a tenement holder to be given to a designated tenement contact (DTC). The DTC is to be determined in accordance with regulations which are yet to be made. When the regulations are made, notices given to the DTC will be deemed to have been given to all the holders of the mining tenement or applicant for a mining tenement.

2.     Section 40C has been amended to allow a miner’s right to be issued to a company.

3.     Section 111 has been amended to authorise the holder of a mining tenement applied for on or after 8 February 2017 to prospect for , explore for or work and mine iron ore (as the case may be). Holders of mining tenements applied for before that date continue to be restricted in that regard until the Minister so authorises the holder.
